Fransman v Speaker of the Western Cape Provincial Legislature and Others (13097/2014) [2016] ZAWCHC 120

This is an application to review decisions allegedly taken by the Western Cape Standing Committee on Public Accounts (‘SCOPA’/‘the committee’) arising from the summonsing of the applicant to appear before it as a witness on 23 April 2014. Other ancillary relief, to which I shall return, is also sought.

SCOPA is a committee established by the provincial legislature in terms of s 116 of the Constitution and the Standing Rules of the Western Cape Provincial Parliament (‘Standing Rules’). It is common cause that, amongst other things, SCOPA is empowered to summons any person to appear before it and/or to produce documents, and to hear oral evidence and examine any reports, including those of the Auditor-General, on the affairs of the provincial executive.
