ATM recommends Justice Molemela & Judge Kathree-Sitiloane to fill the Con Court vacancies

As a party that stands for transformation and inclusivity, Justice Molemela was the first woman Judge President of the Free State bar, equipping her with the necessary experience that will assist the judiciary to apply the many different statutes of the law and transform for the better in ensuring that the three arms of governance in South Africa remain different, yet interdependent. 

In the same light, we positively note that Judge Kathree-Sitiloane, being one of seven female researchers appointed at the inception of the Constitutional Court in 1995, has an intimate understanding of the current Constitution, it’s fundamentals, and by extension, Constitutional law. 

On perusal of Justice Mahube Betty Molemela’s and Judge Fayeeza Kathree-Sitiloane’s profiles, we have also noted that they comply with the provisions of section 176(2) of the Constitution, stating that Constitutional Court Judges are to occupy a 12-year term, or until they attain the age of 70. This is a clear indication that the both the Justices will be able to hold office uninterruptedly, serving the Constitutional Court diligently. 

The calibre of cases which both Justice Molemela and Judge Kathree-Sitiloane have presided over have exposed them, to various avenues of the law, the application of it, and the thorough interpretation thereof, thus qualifying them to be appointed to the Constitution Court bench. 

Considering the above mentioned points, and more that has not been said in this communication, ATM is therefore strongly recommending Justice Molemela and Judge Kathree-Sitiloanes for the vacant positions in the Constitutional Court bench.
