1. Introduction
Section 26 of South Africa’s Constitution proclaims access to housing as a Human Righti, and places a duty on the state, within its means, to take reasonable measures to realise not just access to housing, but access to adequate housing. But it also goes further, stating that no one can be evicted from their home or have their home destroyed without a court order, and forbidding the legislature to pass any law that permits arbitrary evictions.
