President Jacob Zuma has established an enquiry to determine the fitness of Mxolisi Nxasana to hold office as National Director of Public Prosecutions, the Presidency announced on Thursday.
The inquiry, according to spokesperson Mac Maharaj, was established in terms of section 12 (6) of the National Prosecuting Authority Act, 1998 (Act 38 of 1998).
“President Zuma has appointed Advocate Nazeer Cassim as the Chairperson of the enquiry. Advocate Lindi Nkosi-Thomas and Advocate Sthembiso Mdladla have been appointed as additional members,” Maharaj said.
The terms of reference will be published in the Government Gazette today.
Nxasana was appointed into the position in October 2013. But his fitness to hold office came under the spotlight after it emerged he did not have the required security clearance for the post, and revelations of a 1985 murder case and a reckless driving charge. He was acquitted on murder charges.
