President Cyril Ramaphosa has signed Proclamation R180 of 2021 authorising the Special Investigating Unit (SIU) to investigate allegations of corruption and maladministration at the Mogalakwena Local Municipality in the Limpopo Province and to recover any losses suffered by the Municipality or the State.
The SIU investigations in the Municipality will look at transactions that took place between 1 April 2016 or after the date of publication of Proclamation (5 March 2021), relevant to, connected with, or that involve the same persons, entities or contracts investigated under authority of the Proclamation.

The proclamation authorises the SIU to look at alleged:

  • serious maladministration in connection with the affairs of the Municipality;
  • improper or unlawful conduct by officials or employees of the Municipality;
  • unlawful appropriation or expenditure of public money or property;
  • unlawful, irregular or unapproved acquisitive act, transaction, measure or
  • practice having a bearing upon State property;
  • intentional or negligent loss of public money or damage to public property;
  • offence referred to in Parts 1 to 4, or section 17, 20 or 21 (in so far as it relates to the aforementioned offences) of Chapter 2 of the Prevention and Combating of
  • Corrupt Activities Act, 2004 (Act No. 12 of 2004), and which offences were committed
  • in connection with the affairs of the Municipality; or
  • unlawful or improper conduct by any person, which has caused or may cause
  • serious harm to the interests of the public or any category thereof.

Meanwhile, President Ramaphosa has amended Proclamation R12 of 2018 that authorises the SIU to look into affairs of the Roads Agency Limpopo to include:

  • The procurement of or contracting for goods, works or services by or on behalf of the Agency and payments made in respect thereof in a manner that was not fair, competitive, transparent, equitable or cost effective relating to 24 contracts.
  • Maladministration in the affairs of the Agency and any losses or prejudice suffered by the Agency, or the State as a result of such maladministration in relation to the increase of the fees of the Chairperson of the Agency’s Board; and fees or salary payments made to Board members of the Agency’s Board in respect of Board fees, contrary to applicable legislation; manuals, guidelines, practice notes, circulars or instructions issued by the National Treasury or the relevant Provincial Treasury.

The SIU is an independent forensic and litigation agency established by the President in terms of the Special Investigating Unit and Special Tribunal Act, Act 74 of 1996, to investigate serious malpractice, corruption, malfeasance and maladministration in relation to the administration of State institutions, State assets and public money as well as any conduct which may seriously harm the interest of the State and the public.
