Numsa has filed an urgent interdict in the High Court in Johannesburg to halt Cosatu's central executive committee meeting set to take place on Friday.
"It was filed on Friday but we could not confirm it until they received it," National Union of Metalworkers of South Africa (Numsa) general secretary Irvin Jim told Sapa on Tuesday.
He said the Congress of South African Trade Unions (Cosatu) had received the papers on Monday.
"The bottom line is that... Numsa will not have any fair hearing in the CEC [central executive committee]. You are dealing with individuals that have already told themselves that Numsa must be expelled."
He said this was clear from a press conference held by the National Education, Health, and Allied Workers' Union (Nehawu) on Monday, which announced that it wanted Numsa removed from Cosatu.
A decision could not be taken to expel the metalworkers' union without giving them a chance to present a case for why Numsa should not be expelled.
