The Helen Suzman Foundation and Freedom Under Law will today appear before the full bench of the Supreme Court of Appeal to try and prevent former Hawks boss Lieutenant General Berning Ntlemeza from carrying out any of the duties of head of the Directorate for Priority Crime Investigation (DPCI), pending any appeals.
This case originates in the earlier case before the full bench of the High Court in Pretoria, in which the foundations were successful in having Ntlemeza’s appointment set aside on the grounds of irrationality and unlawfulness.
However Ntlemeza is appealing the court’s judgment.
The foundations says if they are successful Ntlemeza will not be able to occupy the office of head of the DPCI until such time, if ever, that he successfully appeals the judgment setting aside his appointment.
