In many socio-economic rights cases, public interest organisations and affected persons struggle to compel the government to comply with the court orders made against them.
There are several reasons for this, but it is often because the court orders the government to perform tasks that require the government to change systems, organisational cultures and individual attitudes. These are not easily addressed by a single court order, and usually court supervision is required to ensure orders are implemented.
This report is based on a workshop on Effective Remedies in Socio-economic Rights Litigation held on 5 December 2023 at Cliffe Dekker Hofmeyr Inc's offices in Johannesburg, South Africa. The workshop was a collaboration between SECTION27, Cliffe Dekker Hofmeyr and Sandra Liebenberg, H.F. Oppenheimer Chair in Human Rights Law in the Faculty of Law, University of Stellenbosch
