The Labour Court today granted Solidarity’s urgent application it brought against Denel for contempt of court and granted an interim order with a deadline of 3 December 2020. Solidarity is currently in the process of issuing warrants of execution.

“Solidarity welcomes the favourable result. Denel failed to obey the court order of 4 August and did not make any payments in compliance with the court order. Therefore, Solidarity had no choice but to approach the court to enforce the order,” Helgard Cronjé, Solidarity’s sector coordinator for defence and aviation said.

Solidarity’s application came after the Labour Court had ordered Denel on 4 August to fulfil all its outstanding contractual and statutory obligations to Solidarity members by no later than 7 August. This included the payment of all outstanding salaries for May, June and July.

“It is ridiculous that even after a court order in their favour loyal employees still have to pay the price for Denel’s crimes and mismanagement of the past. Solidarity could not allow this to happen and approached the court to enforce the court order, thereby compelling Denel to fulfil its obligations. The result in this matter is a victory for Solidarity and all its members who have been affected by Denel’s negligence,” Cronjé concluded.
