The National Prosecuting Authority (NPA) has confirmed that Atul Gupta has filed an application to have a preservation order by Asset Forfeiture Unit (AFU) to the value of R10-million set aside.
Speaking to News24, NPA spokesperson Luvuyo Mfaku said that he had received the court papers early on Monday morning.
Atul says in the papers: "I wish to state at the outset that I am currently outside South Africa."
The papers were signed at the South African Consulate in Dubai
His brother Ajay, is currently a fugitive from the law, according to the Hawks.
Atul denied in his application that he benefitted from controversial Estina dairy farm project. Eight people were arrested last week in connection with the farm.
