AfriBusiness will test the validity of any amendment to Section 25 of the Constitution should Government attempt to alter it in its bid to allow the expropriation of land without just and equitable compensation.

This is AfriBusiness’s response to Deputy President Cyril Ramaphosa’s comments in this regard in Parliament yesterday. Ramaphosa said that the ANC Government was considering amending the Constitution for this purpose.

“It is of great concern that property rights – especially private property rights – in South Africa are increasingly coming under fire from political extremists and Government itself. There seems to be a complete disregard for the inevitable consequences that will flow from such an amendment to the Constitution. That is to be expected, however, from a Government that is unable and unwilling to admit that the lack of progress in land reform is not the result of a Constitutional issue, but rather a Government issue,” says Armand Greyling, Law and Policy Analyst at AfriBusiness.

To assist property owners and help educate them on their rights and responsibilities in terms of land occupation and land reform, AfriBusiness and AfriForum will host a conference on 13 March 2017.
